Welcome to greatwebsites.com.au (the "Website"). This Website is owned and operated by Great Websites (ABN: 72 369 135 438) ("we", "us", "our").
By accessing our Website, engaging our business, or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must immediately cease using both the Website and our services.
1. Use of this Website
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the platform.
You must not attempt to breach the Website's security, introduce viruses, or scrape data from our platform.
2. Payments, Late Fees, and Refund Policy
Change-of-Mind Window: Once a a mockup has been accepted, you’ll have twenty-four (24) hours from the time of the transaction to request a refund for change of mind. After this 24-hour window expires, all payments are non-refundable for change of mind, client-led project cancellations, or changes in your business circumstances, as resources and scheduling are allocated immediately.
Late Payments and Suspension: If a subscription payment remains unpaid past its due date, we will issue a written notice via email. If payment is not received within five (5) business days from the date of that notice, we reserve the right to suspend your services and take your website offline.
Data Retention Post-Suspension: We will retain a secure backup of your website files for five (5) days following a suspension. During this time, you may reactivate your subscription by settling all outstanding fees, or request a handover package of your available files (subject to the platform limitations outlined in Section 4). Following this 5-day period, files may be permanently deleted.
Australian Consumer Law Guarantees: Nothing in these Terms limits, excludes, or modifies any statutory consumer guarantees you hold under the Competition and Consumer Act 2010 (Cth) or any other applicable Australian legislation. If our services fail to meet a consumer guarantee, you are entitled to a remedy in accordance with the Australian Consumer Law (ACL).
3. Domain Name Registration
If requested during client onboarding, Great Websites will register a .com or .com.au domain name on your behalf, up to the value of AUD $30 per year. Domains require annual renewal.
If you cancel your subscription, we will initiate the transfer of the domain name to you. Following this transfer, you will be solely responsible for managing the domain registration, configuring DNS settings, and covering all associated renewal costs.
4. Subscription Cancellation & Site Handover
You may request to cancel your subscription at any time by emailing hello@greatwebsites.com.au. If a cancellation is requested during your first month of service, it will take effect at the end of that initial billing cycle.
The Cancellation Process: To prevent unauthorised account changes, cancellation requests must be made from the primary email address associated with your account. We will contact you within one (1) business day to confirm the request and require you to choose one of two options:
Option A: Transfer Account Ownership (Keep the Site Live)
Choose this option if you want to keep your website live and manage the platform yourself.
Account Transfer: We will initiate the transfer of your website's administrator login and platform ownership within five (5) business days. This timeframe excludes any processing delays caused by third-party platform providers or domain registrars.
As-Is Handover: Once ownership is transferred, Great Websites revokes its access, terminates all technical support, and will not provide platform training or troubleshooting.
Option B: Disconnect the Website Completely (Close the Site)
Choose this option if you want to take your website permanently offline.
File Export: Within five (5) business days of confirmation, we will deliver a downloadable link containing your raw website content files (including copy, media assets, and platform-supported data exports).
Dynamic Disclaimer: Because your website is built on a dynamic third-party Content Management System (such as Squarespace), it is technically impossible to export a fully functioning, editable copy of the visual design, backend styling, or interactive features (such as forms or checkouts). We provide a static content archive only.
General Terms Governing All Cancellations
Domain Transfers: Upon cancellation, we will initiate the transfer of your domain name to you. You must accept this transfer within thirty (30) days. If you fail to accept the transfer, Great Websites reserves the right to let the domain registration lapse, and we accept no liability for the loss of the domain.
Costs & Liability: Following a cancellation request, you assume sole financial and administrative responsibility for all ongoing hosting, domain renewals, and platform subscription fees. Great Websites is not liable for any third-party transfer fees, post-transfer formatting bugs, broken features, or the technical performance of your files on alternative hosting environments.
5. Acceptable Use & Prohibited Content
We hold our business and our clients to high ethical standards. We reserve the absolute right to refuse service, cancel active projects, or decline business with any individual, group, or entity that we deem, in our sole discretion, to be operating dishonestly, engaging in deceptive marketing practices, misleading consumers, or bringing Great Websites into disrepute.
Furthermore, we strictly prohibit the use of our services to design, build, host, manage, or support websites containing, promoting, or linking to:
Pornography or sexually explicit, adult-oriented material.
Violence, incitement to violence, or the glorification of harm against individuals or animals.
Hate speech, discrimination, harassment, defamation, or vilification based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or age.
Illegal activities, fraud, scams, pyramid schemes, or any content that violates Australian or international laws.
6. Right to Refuse or Terminate Service
We reserve the right to refuse service to anyone for any lawful reason at any time.
If we discover a breach of Section 5 (Acceptable Use & Prohibited Content) either during a project build or after a website has launched, we reserve the right to immediately terminate the business relationship, halt all work, and withdraw technical support without prior notice. In these instances, to the extent permitted by law, no refunds will be issued for work in progress or completed.
7. Intellectual Property (IP) Ownership
Our Intellectual Property: All content on greatwebsites.com.au including text, graphics, logos, designs, and code, is the property of Great Websites. We retain all intellectual property rights in any underlying templates, custom code, or styling frameworks utilised to construct your website.
Your Intellectual Property: You retain ownership of all text, images, branding materials, and data that you supply to us for inclusion on your website.
Client Licence: While your subscription is active and fully paid, Great Websites grants you a non-exclusive, non-transferable licence to use the website visual layout and configuration as built on the third-party platform. Upon cancellation, this licence terminates, and your rights are limited to your raw data and content files as delivered under Section 4.
8. Third-Party Infrastructure and Services
Our Website is built and hosted using third-party infrastructure, including but not limited to Squarespace, Microsoft, and Stripe. By using this Website, you acknowledge that your interaction with the site is subject to the technical limitations and structural terms imposed by our host (see the Squarespace Terms of Service).
We utilise payment processing facilities including invoicing and customer emails provided by Stripe. Your interactions with us via these systems are subject to the Stripe Services Agreement.
We utilise software and productivity suites provided by Microsoft to manage our business operations and communications. Your interactions with us via these systems are subject to the Microsoft Services Agreement.
To the maximum extent permitted by law, we are not liable for any disruptions, technical failures, or service outages caused by these third-party providers.
9. Limitation of Liability
Great Websites provides its services and this Website on an "as is" and "as available" basis. While we strive for technical accuracy and uptime, we do not guarantee that the Website or your hosted site will be entirely error-free, uninterrupted, or free of viruses.
To the maximum extent permitted by law, and subject to any non-excludable rights under the Australian Consumer Law, our liability for breaching any implied warranty or condition is limited, at our option, to re-supplying the services or paying the cost of having the services supplied again.
In no event will Great Websites be liable for any indirect, incidental, or consequential damages, including loss of revenue or business profits, arising out of your use of, or inability to use, our services.

This Website may contain links to third-party websites. These links are provided for convenience only; we do not endorse, control, or assume responsibility for the content or privacy practices of these third-party sites.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Australian Capital Territory (ACT), Australia. You irrevocably submit to the exclusive jurisdiction of the courts in the ACT.
12. Changes to Terms
We reserve the right to amend these Terms at any time. Your continued use of the Website or our services following any updates signifies your acceptance of the revised Terms.
